Disclaimer

All our Hypno Imp programmes include hypnosis and hypnotherapy techniques and therefore should not be listened to when driving or operating machinery or while you are under the influence of alcohol or recreational drugs. If you suffer from epilepsy or clinical depression you should consult your doctor or medical practitioner before using your Hypno Imp.

The recording on your Hypno Imp is copyright protected. Do not illegally copy or distribute the files on your MP3 player. If you have obtained your Hypno Imp recording from anywhere other than our website, www.hypnoimp.co.uk or from one of our approved retailers, please let us know by emailing kala@hypnoimp.co.uk

Do not use your Hypno Imp as a substitute for medical assistance. If unsure, please consult your doctor or other medial practitioner for advice. Complimentary health therapies of any nature, including hypnotherapy, are not intended to substitute the diagnosis and care of a qualified medical professional. Whilst undertaking hypnotherapy or any other kind of complimentary therapy, DO NOT adjust any prescribed medication for any existing condition without the approval of your doctor. If you are in any doubt, please consult your GP.

Prices and Payments

Hypno Imp must receive full payment for the goods before your order can be accepted. Once payment has been received, cleared and the funds transferred, Hypno Imp will confirm that your order has been accepted by sending you an email to the address which you have supplied on your order.

Hypno Imp’s acceptance of your order brings into existence a legally binding contract.

All of the information you give to Hypno Imp is private and secure. Hypno Imp does not disclose personal customer details to any other companies.

Hypno Imp are bound by the Data Protection Act 1998. Your data protection rights are set out in our Privacy Policy.

Hypno Imp reserves the right to alter prices of their goods without prior notification.

Availability

Hypno Imp will do it’s best to fulfil every order within 28 days of confirmation, but we cannot guarantee this in every instance. Hypno Imp will endeavour to inform you of any problems as soon as is practicably possible either by email, telephone or letter.

Delivery

Hypno Imp will deliver by post using Royal Mail and the flat rate charge of £2.95. We send out your order recorded delivery second class. We will send your Hypno Imp to the address you supply for delivery at the time of your order.

Dispatch will be made as soon as possible after your order confirmation is accepted and in the majority of cases within 7 days of confirmation.

Once payment has been received, you will become the owner of the goods and they will be held at your own risk. Hypno Imp will not be responsible for their loss or destruction.

Faulty Goods and Returns

If you are experiencing problems with your Imp and think that it’s faulty, please read our troubleshooting guide at www.hypnoimp.co.uk/troubleshoot to see if you can resolve the problem. If not, please refer to our Customer Service Guarantee.

Customer Service Guarantee

In the case of faulty goods that have not been damaged deliberately, smashed or water damaged, Hypno Imp will send a replacement order to you if the conditions set out below are adhered to. You must notify us if you are returning goods. If you require a refund, then you must request this in writing, to our mailing address, with the reasons why you would like a refund within 30 days of the order being accepted by Hypno Imp Ltd.

Return of goods must be in their original condition and within 30 days of your order being accepted for a complete refund. The goods need to be returned together with your delivery note or invoice number and your name and address. You will need to send them in appropriate packaging such as a padded envelope, bubble wrap or other protective packaging. Please send them to:

You may wish to send your returns by registered or recorded delivery as Hypno Imp cannot take responsibility for goods lost in transit and we may have to charge you for a replacement order.

You must contact Hypno Imp for authorisation to return goods. Any goods returned without authorisation or which are not in the condition set out above will be rejected and returned to you at your cost.

If the goods Hypno Imp despatches to you are not what you ordered, appear damaged prior to posting, defective or the delivery contains an incorrect quantity you MUST notify Hypno Imp in writing (at our mailing address) of the problem with 7 days of receiving the order or by telephoning our Customer Service Department on 08716 641467.

If you do not receive the goods ordered by you within 30 working days of the date on which you ordered them and have not been contacted by Hypno Imp with a rationale for non-delivery, you must notify Hypno Imp in writing at our mailing address or by telephoning the Customer Service Department on 08716 641467 WITHIN the 30 day time period.

If you notify in writing, a problem under the above listed conditions to Hypno Imp, we will at your option;

1. Make good any shortage on non-delivery;

2. Replace any goods damaged or defective prior to delivery, or

3. Refund to you the amount paid for the goods.

Hypno Imp shall not be liable for any indirect loss or expense (including loss of profit) arising out of a breach of its obligations unless you have previously given notice that such loss is likely to be incurred in the event of a breach.

Nothing in this contract is intended to limit your statutory rights nor in any way to exclude or limit Hypno Imp’s liability to you for any death or personal injury resulting from its negligence, or for fraud.

We cannot offer a guarantee that the hypnotherapy contained within the Imp will bring about the desired effects, but if used as directed it should remove the obstacles and negative thinking that prevents you from achieving your desired goal be it giving up smoking, losing weight, overcoming a fear of flying etc.

Force Majeure

Hypno Imp reserves the right to defer the date of delivery or to cancel the contract if it is prevented from or delayed in carrying on of its business due to circumstances beyond its reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, lock-outs, strikes or other labour disputes (whether or not relating to Hypno Imps workforce) or restraints or delay in obtaining supplies of adequate or suitable materials.

General

If any part of these conditions is unenforceable (including any provision in which Hypno Imp excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

This contract shall be governed by English Law and the parties submit to the exclusive jurisdiction of the English courts.

Entire Agreement

These terms and conditions represent the entire understanding between you and Hypno Imp Ltd and supersedes all previous proposals, representations, understandings and prior agreements (whether written or oral) and other communications.

As a customer, you must warrant that you have not been induced to enter into an agreement, sale or contract with Hypno Imp by any prior representations whether oral or in writing except those stated in these terms and conditions.

In the event that any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, void or illegal then this shall not affect the remaining terms and conditions which shall remain in full force and effect.

Governing Law:

Your contract with us is governed by the laws of England and Wales and the English Courts will have jurisdiction over any disputes which may arise between you and us in connection with the contract between you and Hypno Imp.

Warnings:

None of our products are intended for use in the diagnosis, treatment or cure of any physical or mental condition or dysfunction.

Our products may induce a state of hypnosis. Do not use Hypno Imp products if you are susceptible to health problems due to hypnosis. Seek medical advice from your GP or health practitioner if you are unsure and read our disclaimer prior to using Hypno Imp products.
